General Terms and Conditions

1. Scope

These General Terms and Conditions apply to all appointments and tattoo services provided by:

Individual agreements made with the client take precedence over these General Terms and Conditions.

2. Appointment Booking

An inquiry submitted via the website, email, WhatsApp, telephone or social media is initially non-binding.

A tattoo appointment becomes binding once it has been confirmed by Tattooine Sayagata and any requested deposit has been received by the specified deadline.

If the deposit is not paid within the stated period, the appointment may be released again.

3. Design and Scope of Services

Before the appointment, the design, style, body placement, approximate size and expected amount of work will be agreed in particular.

If the client subsequently makes material changes to the design, size or placement, the duration and price may change. Extensive changes may require a new appointment.

Before tattooing begins, the client reviews and confirms the final design, placement and size, as well as any spelling, numbers and dates.

4. Prices and Payment

The price is based on the agreed design and the actual amount of work required.

Prices quoted in advance are non-binding estimates unless a fixed price has been expressly agreed.

The deposit paid will be credited towards the total price. The remaining amount is due after the tattoo session.

5. Deposit via Stripe

A deposit may be required to reserve an appointment on a binding basis. The amount will be communicated to the client before booking.

Payment may be made through the payment service provider Stripe. Tattooine Sayagata remains the contracting party for the tattoo service.

The deposit secures the appointment and is not charged in addition to the agreed tattoo price.

6. Cancellation and Rescheduling

If an appointment cannot be attended, Tattooine Sayagata must be informed as early as possible.

An appointment may be rescheduled once, provided this is done no later than 48 hours before the appointment. In this case, the deposit will be transferred to the newly agreed appointment.

In the event of a later cancellation, a further rescheduling request or a no-show, the deposit may be offset against the loss incurred and services already provided.

In particular, work already carried out on the design, the reserved working time, the possibility of assigning the appointment to another client and any expenses saved will be taken into account.

The client may provide evidence that no loss or a substantially lower loss was incurred. If the loss incurred is lower than the deposit, the remaining amount will be refunded.

7. Late Arrival

Tattooine Sayagata must be informed immediately if the client is running late.

Depending on the length of the delay, the available tattooing time may be reduced. If the appointment can no longer reasonably take place due to a significant delay, the provisions on short-notice cancellations apply accordingly.

8. Cancellation by Tattooine Sayagata

If an appointment has to be cancelled, in particular due to illness or other important reasons, an alternative appointment will be offered.

If no alternative appointment can be agreed, the deposit paid will be refunded in full.

9. Requirements for Tattooing

As a general rule, only persons aged 18 or over will be tattooed. Tattooine Sayagata may request valid photo identification.

Before the appointment, the client must provide truthful information about any health circumstances that may be relevant to the tattoo. This includes, in particular, allergies, skin conditions, infections, blood clotting disorders, relevant medication, pregnancy or other health restrictions.

Tattooing may be refused or postponed where there are health concerns, injured or inflamed skin, or evident alcohol or drug influence.

If the client is responsible for the reason for refusal, services already provided and the loss of the appointment may be offset against the deposit.

10. Designs and Reference Material

Designs created by Tattooine Sayagata are protected by copyright.

They may not be passed on to other tattoo artists, reproduced, published or otherwise used without express permission.

If the client provides their own reference material, they warrant that its use does not infringe any third-party rights.

11. Liability

Tattooine Sayagata has unlimited liability in cases of intent, gross negligence and damage arising from injury to life, limb or health.

In the event of a slightly negligent breach of material contractual obligations, liability is limited to foreseeable damage typical of the contract.

Tattooine Sayagata is liable for consequences resulting from incorrect or incomplete information provided by the client or from failure to follow the aftercare instructions only where Tattooine Sayagata is at fault.

12. Right of Withdrawal

If a contract is concluded exclusively online or by other means of distance communication, consumers may have statutory rights of withdrawal.

Any withdrawal information required by law will be provided to the client separately.

If, at the client's express request, Tattooine Sayagata begins providing an individually agreed service before the withdrawal period has expired, the client may be required to pay compensation for the service provided up to the time of withdrawal.

13. Data Protection

Information on the processing of personal data and payment processing via Stripe can be found in this website's Privacy Policy.

14. Consumer Dispute Resolution

Tattooine Sayagata is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

15. Final Provisions

The law of the Federal Republic of Germany applies. For consumers, this applies only insofar as it does not restrict any mandatory statutory protections of the country in which they have their habitual residence.

If any provision of these General Terms and Conditions is invalid, the remaining provisions remain unaffected.
